Right of Use Request

Thanks so much for your support! We're really pleased you're happy with your Laco watch. We like your post so much that we were wondering if we could share your picture on our website and social media channels. We'd therefore like to ask you for the rights to your UGC ("User Generated Content").
1) We contact our clients to ask their permission to use their UGC on our website and social media channels. If you allow us to use your photos in the way described below, we will include your account name and credit you as the creator on the posts.
2) By responding to this Right of Use Request with #yesLACO, you are agreeing to the following licensing terms:
Rights of use
You hereby grant the non-exclusive, free of charge right, without restriction in time or place, to use your UGC for our website and social media channels. Additionally, you allow us to save, distribute, make publicly available, and (subject to § 14 of the Copyright Act), modify and process your UGC ("Licence").
This license is:
- "non-exclusive", you may use your UGC for other purposes and may allow others to use your UGC for their purposes at any time
- "free of charge" i.e. without payment We do not owe you anything for the use of your UGC
- "without restriction in time", you are granting us the licence for an indefinite period
- "without restriction in space", we may use the licence anywhere in the world
You promise us
- that you have the right to grant us the licence to the extent described
- that you have obtained the agreement of everyone depicted in the image
- that your UGC may be used to the extent described
- that you have paid all licence fees or other fees which may relate to your UGC in full
- that your UGC does not infringe on third-party rights, e.g. intellectual property or personal rights - that you, as a natural person who is aged at least eighteen (18) years old or that you, as legal representative, agree to the licence to the extent described
We reserve the right to stop using your UGC at any time, and to remove it without replacement.
This agreement is exclusively subject to GERMAN law, to the exclusion of the UN sales law. If you are a consumer, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which you have your habitual residence. If you are a merchant, entrepreneur within the meaning of § 14 of the Civil Code, or a legal entity under public law or a special fund under public law, or if you do not have a general place of jurisdiction in the Federal Republic of Germany, or if your place of residence or habitual abode is unknown at the time the action is brought, our place of business shall be the exclusive place of jurisdiction - including international jurisdiction - for all disputes arising from or in connection with this agreement.

We are required to process your data for the purposes stated to be able to handle your request appropriately (art. 6 para 1 section 1 b and c GDPR).
3. Source of personal data
Your personal data are sourced from your publicly-accessible Instagram profile.
4. Passing on data ("Recipients" or "Categories of recipients")
In principle, within our company only people who are required to access your personal data for the purposes for which it is being processed will be able to do so.
Data will only be passed on to third parties if and insofar as doing so is necessary to handle your request.
Data passed on will only be processed by the recipients for the aforementioned purposes. Processing for other purposes is not permitted.
5. Retention period
The personal data we collect for this purpose will be retained until our collaboration has ended, and then be deleted immediately.
6. Data subject rights
You have the right:
- to revoke any agreement you have given us at any time, as a result of which we will no longer be able to process the data to which your agreement related in the future (art. 7 para 3 GDPR);demand information about your personal data processed by us (art. 15 GDPR). In particular, you can request information about the processing purposes, the type of personal data, the respective recipients of your data, the planned retention period, the origin of your data (if it has not been collected by us), and whether there is an automated decision-making process including profiling and, if applicable, meaningful information about its features;
- to demand any incorrect or incomplete personal data we hold be rectified (art. 16 GDPR) immediately;
- to demand the personal data we hold on you be deleted, provided the processing of this data is not required to meet a legal obligation, is in the public interest or for the assertion, exercise or defence of legal claims on our part (art. c GDPR)
- to request the processing of your personal data be restricted, if the accuracy of your data is contested or its processing is illegal (art. 18 GDPR);
- to request to receive the personal data you have provided to us in a machine-readable format or to have it transferred to another data controller (Right to data portability, art. 20 GDPR), and• to complain to a supervisory body (art. 77 GDPR)
7. Right of objection
Insofar as processing your personal data,
- is required pursuant to article 6 para 1 e GDPR to perform tasks which are in the public interest or are in the exercise of official authority transferred to us, or
- is taking place based on legitimate interests pursuant to art 6 para 1 f GDPR,
- profiling based on the two aforementioned provisions showsthat under article 21 para 1 GDPR shows that you have the right to object to your personal data being processed insofar as there are reasons which are the result of your specific situation.
